In compliance with article 10 of Law 34/2002, of 11th July, on Information Society Services and Electronic Commerce (LSSI-CE), we inform you that the owner of the website www.portcalella.com (from now on, the “Website”) is Finques Port Calella, with registered office in the town of Calella de Palafrugell, C/ Chopitea, 26 – CP 17210, with CIF E55284582 (from now on, “Finques Port Calella”).
Any communications which may be necessary between Finques Port Calella and the User must be sent to the Customer Service Department by sending an e-mail to info@portcalella.com, or by calling the number 972615454, or by sending a written communication to our Customer Service Department at the above-mentioned address.
Our customer service hours are as follows:
- 1 January to 22 June: open from Tuesday to Saturday, from 10:00 to 13:00 and from 16:00 to 19:00
- 23 June to 20 September: every day of the week, including Sunday, from 11:00 to 13:00.
- September 21st to December 31st: open from Tuesday to Saturday from 10:00 to 13:00.
1. Acceptance of the Conditions of Use
1.1. The purpose of these Conditions of Use is to regulate the availability of information and services provided by Finques Port Calella through the Web.
1.2. By browsing the Web you automatically acquire the status of User (hereinafter “You” or “User”) and accept without reservation of any kind, each and every one of this Legal Notice.
1.3. To start using the Web it will not be necessary that the User registers previously, nor that he expressly accepts this Legal Notice. However, the User is aware that it is his obligation to know and respect this Legal Notice and our Privacy Policy from the moment he accesses the Web.
1.4. Finques Port Calella may modify this Legal Notice by publishing these modifications on the Web so that they may be known by users.
2. Intellectual and Industrial Property Rights
2.1. All the content of the Web, including but not limited to its programming, edition, compilation, designs, logos, images, text and graphics, are the property of Finques Port Calella, and are protected by national and international regulations on intellectual property. Access by the User does not grant him/her any right of ownership over them.
2.2. If you see any content on the web site that could infringe intellectual or industrial property rights, please inform Finques Port Calella as soon as possible by sending an e-mail to info@portcalella.com.
3. Civil Liability
3.1. Finques Port Calella will not be responsible for any damage or harm that the user may suffer as a consequence of using the web when he or she proves that he or she has fulfilled the requirements and diligence demanded by the nature of the web.
3.2. We do not control, in general, the use that Users make of the Web. In particular, we do not guarantee under any circumstances that Users will use the Website and its tools in accordance with the law, this Legal Notice, generally accepted morals and good customs and public order, nor that they will do so in a diligent and prudent manner.
3.4. In the event that the Web has links or hyperlinks to other places on the Internet, we will not exercise any control over these places and content. Under no circumstances will we assume any responsibility for the contents of any link belonging to a foreign website, nor will we guarantee the technical availability, quality and veracity of any material or information contained therein.
4. Exclusion of Guarantee
4.1. We do not guarantee that the Web will be executed without interruptions, in useful time, reliable, free of errors or viruses and we are not responsible for any possible damage or harm that may be derived from interference, omissions, interruptions, computer viruses or disconnections in the operating system of this electronic system, caused by causes beyond the control of Finques Port Calella.
4.2. It is the responsibility of the User to adopt all appropriate technical measures to reasonably control these risks and avoid damage to their equipment, loss of data and theft of confidential information. To this end, they must have up-to-date systems for detecting malicious software, such as viruses, Trojans, etc., as well as having the security patches of the corresponding browsers used.
5. Users' Obligation

5.5. Not to introduce, store or disseminate any computer program, data, virus, code, hardware or telecommunications equipment or any other electronic or physical instrument or device that may cause damage to the Web or prevent its normal operation.
5.6. Not to destroy, alter, use for use, disable or damage the data, information, programmes or electronic documents of Finques Port Calella, its suppliers or third parties.
5.7. Not to introduce or disseminate any false, ambiguous or inaccurate information or content in such a way as to mislead the recipients of the information.
6. Minors
In general, in order to use the service minors must have previously obtained the authorisation of their parents, guardians or legal representatives, who will be responsible for all acts carried out through the website by the minors in their care. In those services where it is expressly indicated or determined by law, access will be restricted solely and exclusively to persons over 18 years of age.
7. Duration and termination
The services are made available for an indefinite period. Notwithstanding the above, we are entitled to unilaterally terminate, suspend or interrupt, at any time and without prior notice, the marketing of our products.
8. Applicable law and jurisdiction
This Legal Notice is governed by Spanish law. The parties submit, at their own discretion, for the resolution of any conflicts and renounce any other jurisdiction, to the courts and tribunals of the domicile of La Bisbal d’Empordà.
